Remarks:
It is pertinent to point out here that I was appointed as an RP on 27.11.2019 before that Mr. Prabhjit Singh Soni was the IRP and was handling the CIRP Process for a period of 321 days since 10.01.2019. The payments made by us includes payments made for work done during the IRPs tenure. Thereafter as per the Order dated 11.10.2022 of IBBI and High Court Order dated 31.10.2022, I have remitted the office of the RP and now Mr. Devendra Singh has been appointed as the RP of the Corporate Debtor by the CoC and approved by the Honble NCLT vide Order dated 21.11.2022 which was communicated / uploaded on 30.11.2022. It is also pertinent to point out that the Resolution Plan has been approved by the CoC but pending adjudication before the Honble NCLT since 13.08.2020. The primary reason for the delay in approval of the Resolution Plan was that the issue with regard to status of Noida Authority being a Financial Creditor or Operational Creditor was pending adjudication before the Honble Supreme Court and was finally adjudicated by the Honble Supreme Court of India vide Order dated17.05.2022.
