Remarks:
Since the Hon'ble Supreme Court has set aside the order of CIRP admission, my appointment as IRP was a nullity. Hence, the question of demitting the office as IRP/RP does not arise. The legal position in this regard is discussed in the decision of Shree Chamundi Mopeds delivered by Hon’ble Supreme Court. Since initiation of CIRP was a nullity, no cost could be incurred for the same to file the cost disclosure statement. This issue was never raised earlier by the IPA for AFA applications in earlier years and have been issuing the AFA for the years 2020-21, 2021-22 and 2022-23 till the present AFA expiring on 19.12.2023. In this background, please inform the procedure regarding the cost disclosure statement.
